Diversion Notice
Pursuant to K.S.A. 22-2906 et seq., the Bourbon County Attorney's Office has established a Diversion Program. You may be eligible to participate in the Diversion Program. Diversion is a contract between you and the County Attorney’s office. Upon entering into a Diversion the court proceeding will be stayed. If the terms of Diversion are fulfilled the County Attorney’s office will dismiss the charges. Should you fail to fulfill the terms of Diversion the County Attorney’s office will revoke the Diversion. The matter will then proceed on stipulated facts and, if convicted, you will be sentenced by the Court.
Not all offenses are eligible for Diversion. Depending on the circumstances of the offense and your criminal history you may not be eligible for Diversion. For more information about the Diversion Program and eligibility requirements, see the Diversion Policy.
